questions about probate and deputyship

I have mentioned the situation before but in short, my brother is in a coma in hospital and is a single father to a 16 year old girl. I am trying to work out what to do practically. He has no income now and also has no insurance. These are my current problems:

He owns two flats. One he was living in with his daughter and another he has been trying to sell for a year. He is also hugely indebted which is why he was trying to sell his second flat. The second flat currently has tenants but they are difficult and haven't paid the last month's rent.

  • If I manage to get deputyship, which seems to take months even for an interim author, can I complete the sale of his second flat while he is in the coma?
  • If he dies and I am an executor, can I rerent his second flat under probate? I am assuming the existing tenants would not be immediately evicted but I would ideally like them to leave to get new tenants in who actually pay the rent. I am also assuming that if I have deputyship I can rerent the flat while he is still alive.

Unless there is a restriction in the deputy order, you will be able to complete the sale of his second flat or let it provided it is in his best interests.

As executor you will be able to relet the property provided it is in the best interests of the estate.
