Unauthorised photography within my home and sharing of the photographs

I found out that a contractor has taken photographs of the inside of my home that I did not authorise, one of them has got my child in the corner I’m fucking furious about. Obviously it’s gone from one employees phone to another and then it’s been forwarded onto who is thinks is me but actually I’m using an email address that isn’t the one that he would have on my contract if that makes sense so I think he’s on thin ice with that.

This can’t be legal surely ?

Yes it absolutely does. By taking those photographs they have now become data handlers and I believe need to be registered with the ICO and handle my data accordingly.

Not necessarily op. Having photographs of your property does not automatically mean that you have to register with the ICO. There are exemptions and this is likely one of them.

If they took a picture of your doorway but your son’s face is in the corner, where were you or another adult when the picture was taken? If it’s so clearly him I don’t understand how no one noticed a shot was about to be taken with his face showing.

Have you sent an email back asking them to delete the picture or crop out your DC’s face at the very least? I’m just so confused right now

I can see that you’re annoyed, but you’re focusing on the wrong thing. Focus on your money claim, not on a data breach.

You’re wasting your time, money and breath on an ICO complaint. It isn’t a compromising photo, there’s no gain from the person having taken the photo.

It’s bizarre that someone could be happy to leave a 2 year old unsupervised with contractors and deemed this to be perfectly safe, but as soon as they took a picture of the room to clarify that the work wasn’t possible the child’s privacy or whatever has suddenly been breached. Bizarre.

  1. What work were you planning on having done?
  2. Did you pay the whole amount up front or a deposit?
  3. What was the contractors' reason for not carrying out the work?
  4. What have they said about rescheduling or you losing the money?

None of that is clear.

Op you are wrong
having someone’s data does not mean you need to be registered
that would mean it applies to everyone with a camera on their house or cctv on their drive

its about use and intent

they shared it with you and the boss

besides for gdpr data only applies if it is identifiable so unless there’s a name plaque next to your child it won’t apply

it about identifiable info and more importantly the sharing rather than the collection

"right to privacy" laws in the UK are only applicable to press, newspapers, journalist etc.

If a journalist from the Sun came along, took a photo of your living room with your toddler in it, published an article about, idk, "The huge problem with contractors in Milton Keynes not fulfilling their carpeting jobs" and used that photo with the caption "Mrs Divine of Milton Keynes' Living Room" you'd have a chance of a case under "right to privacy".

As for "Data handlers".... 😂

Ok, are you saying they did not tell you they couldn’t do the work first, or ask you to sort out whatever the problem was stopping them . They didn’t say anything to you and just took photos, left , sent to main contractor and they’re now saying you’re at fault .
effectively they gave you no chance to sort it out first?

If the quality of communication with the contractors was as clear as it is on here, I can see why photographic evidence might have been considered necessary.

I once had a lovely couple of plumbers out to power flush my radiators. Except, turns out I had "pinholes" in my radiators so they couldn't do the flush because they would rupture. Young fella said he needed to take photos for the office to show why they couldn't do the job (but still charge me for the call-out). The office emailed them back to me. There was my big ugly grey bra drying on the bedroom radiator.

You're coming across as though you've lost the plot.
Forget about the photo, you're on a hiding to nothing with that and focus on sorting out the issue so they can do the job or getting them to refund you.

@BadNomad - sorry but that made me laugh because a similar thing happened to me. Sent proof of parcel delivery, parcel in open doorway with my bra in the background on the floor by the stairs where’d I’d thrown it when I got in. If only I’d known DPD would have to delete it under GDPR 😂

You hired a contractor to, for example, hang glittery grey wallpaper.

The contractor arrived and noticed the wall you want papered is currently tiled and can’t be papered over.

He says he can’t do the work, and this is because you didn’t tell him about the tiles?

Words ensue (??)

He takes a photo of the tiles as evidence of why he can’t complete the wallpapering job.

Your unsmiling toddler is on a sofa facing a tv but also facing the open door and is caught in the photo?

I was thinking exactly the same. My word the Op must be perfection personified in all areas of their life to be this angry about others.

This is why I feel so sorry for front line workers in any industry.

However, I do hope it gets resolved for you Op
