Unauthorised photography within my home and sharing of the photographs

I found out that a contractor has taken photographs of the inside of my home that I did not authorise, one of them has got my child in the corner I’m fucking furious about. Obviously it’s gone from one employees phone to another and then it’s been forwarded onto who is thinks is me but actually I’m using an email address that isn’t the one that he would have on my contract if that makes sense so I think he’s on thin ice with that.

This can’t be legal surely ?

If you have a good reason for getting your money back focus on that.

I don't think contractor is wrong to show evidence of why they can't do work as i expect most people get upset when this happens.

So you are saying they were taking picture of the hallway and the child was in the room, so it's likely they didn't realise the child was in the frame when they took the picture or the child walked into the frame while they were taking the picture. Either ways don't think their intention was to take a picture of your son. You can let them know that you are not happy that the picture has your child in it and ask them to delete it. I agree they should have probably let you know verbally that they can't do the job and ask before taking a picture as evidence. But, it's not a big issue really and I suspect your anger is misplaced. It is more because they have claimed you are in breach of contract and didn't complete the job and you are angry at them and looking for ways to get out of it legally or get compensation.

Yes it absolutely does. By taking those photographs they have now become data handlers and I believe need to be registered with the ICO and handle my data accordingly. I guess the grey area is the fact that they were invited into the house and that’s what I was hoping to seek clarification on.

If they are a business that handles any data that can identify clients (e.g. names/addresses), they will already be ICO-registered.
They will be the data controllers of the data, including photos.
As long as they handle the data in accordance with the DPA 2018/GDPR, and any privacy agreement that they may have signed with you, they have not done anything wrong, in terms of their data management.

My bet is its flooring, she's paid for it to be installed, they have turned up and there's furniture in the way, contractor took photographs to prove to his boss that the room wasn't cleared because you were being unreasonable?

Luckily I have text messages that confirm the other position/aspect of the dispute is incorrect. Fuck me for them to turn around and say here’s a photograph of your house that we took without your permission. I’m sorry I’m absolutely furious how dare they and if that is the legal position it makes me think twice about who will be coming in through the front door.

Aw, we're probably being a bit mean to OP here. In amongst all the guff about contractors and hallways and whatnot, she's probably just worried that someone she doesn't know has a photo of her kid on their phone.

OP, literally anyone anywhere can and does take photos of you and your child or when you're out of the home. We are tracked by CCTV and cameras wherever we go, all the time. The days of a general expectation of privacy are long gone. You're an idiot if you think everybody abides by the law in handling those images. You're better off relying on most people's apathy and utter lack of interest in you (unless you're naked or doing something criminal or stupid or funny).

You're being a bit "my home is my castle" if you say yes but this was inside my home. I mean, you invited them in. Literally everyone under the age of 70 and many over have camera phones these days. Many many people can't experience something without photographing it. They were contractors with whom you were disputing something and they have a responsibility to their boss or they won't get paid - they're not interested in the back of your kid's head. They're interested in keeping their jobs. They're not disputing something you said (which they could have recorded). They're disputing a visual thing. Of course they're going to take a photo. Just let it go.

OP, what is the current position with the contractors re doing the work?

  • are they saying that they can’t do the job at all, and are keeping some or all of your money?
  • are they saying they won’t do the work, are keeping the money you’ve paid PLUS are going to charge you extra?
  • are they saying they can do the work but you need to do XYZ first?
  • or something different?

I didn’t understand your comment in your initial post about them using a different email, could you expand on that?
