Hey,
I need some help please as I’m not sure where I stand - hoping someone has been in a similar situation.

So me and my ex partner are selling our home but due to the market it’s proving difficult. I can no longer live with him as it’s affecting my mental health but I can’t afford to rent on my own and pay my mortgage.

Does anyone have any advice on how I can get round this please? Or any legal contract that can be written up so I don’t have to pay the mortgage if I’m not living there.

If the mortgage is in joint names, any agreement/contract you enter into with your partner is not binding on the lender. If he fails to pay the mortgage, they will still be able to come after you for payment. The only way out of this would be for him to buy you out and take on a new mortgage in his sole name.

Unfortunately you’re still liable as above - if you’re choosing to move out it’s also not really fair that he’s left with the whole mortgage.

Can you move in with a friend or family member until the sale goes through?

If you’re looking for a way to lump him with 100% of the mortgage payment, you won’t find one without both his and the lender’s agreement.

@mattyprice4004 he’s asked me go numerous times and he won’t reduce the house price so we can get a sale so I don’t really have much of a choice. I don’t have anywhere else to go and I can’t keep living with the up and down insults one day and the nice side the next .
