Dismissal of non-mol

Hello,

Months after taking out a non-mol against my ex partner, I decided I no longer wanted one.

The police were incredibly unhelpful along the way.
Ex breached the non-mol 23 times over 6 months. I would spend hours reporting each breach, giving interviews to police etc only for no repercussions to actually take place.

I was only partially eligible for legal aid. Spent £5.5k, all my savings on legal fees.

I moved home and moved the children's schools, changed our numbers - ex doesn’t know where we are.
Therefore I don’t need a non-mol - it didn’t work as it was supposed to and I have no more money to spend on legal anyway.

I spoke with my solicitor in August to tell her I was dropping the non-mol and wrote an email to be presented to the judge to explain my stance.

I have now received an email from solicitor stating there is a family court date set for Monday 31st!

I am not attending this, I already stated why.

I am just wondering if court still does go ahead, irrespective, if there will be any implications for me?

Any advice please?

I don't see any reason you can't just leave the non mol in place why do you want to have it removed? Of course that needs to be done in court therefore costing money.

I’ve moved so it’s not actually valid as it’s in the old address.

I cannot afford court fees.

The non mol doesn’t work - why continue emotional effort, actual time and money you don’t have for something that doesn’t work?

Because if it's already in place it's not going to make much differenceConfused I get what you're saying about him breaching it but removing it isn't going to change that either. Addresses can be changed on non mols a lot easier and cheaper than it is to remove them.
