Hi I am the respondent in a c100 application the applicant now wants to withdraw the application and has said they have told the court but we still have a court date listed
I want the case to go ahead or at the very least a consent order drafted
can the applicant just withdraw? Do I get any say in the process? I feel that we need some legal conclusion

He needs the court's permission to withdraw the application. The court will contact you and notify you of his request before considering whether he should be allowed to withdraw the application. You can then tell the court you want the application to proceed and set out your reasons.

Thank you for the reply I appreciate it as I am representing myself so it’s quite a daunting time
