Background check and ccj against business

Please help. Will a CCJ show on on a background check on one small business that I own or is because it's a separate entity they can't hold it against me. (Not finance job, but head of dept) ccj was 4 years ago. I can find lots to say if you've been to jail they can't discriminate but nothing on this matter

What do you mean by a background check? A CCJ won’t show on a DBS check as it isn’t a criminal offence. Unless you as a Director of the company also offered a personal guarantee connected to the business, a CCJ against your business also won’t be on your personal credit file if the employer is going to credit check you. If they’re asking you to declare whether you as an individual or company director have ever received a CCJ then obviously you have to declare that.

It depends on the legal entity of your business.

If it was Limited and a CCJ was registered against the company, this is unrelated to your personal credit file and no personal credit check will show this.

If you were a Sole Trader, the CCJ will be against you as an individual and will be on your personal Credit File.

I must disagree with the pp though on the Limited Company/personal guarantor point. If a CCJ was registered against a Ltd Company debt for which you, as Director, had offered a personal guarantee - the CCJ still will not show on your personal credit file. No lending contract exists between bank and Guarantor for the debt itself and any CCJ is still for the business only. In cases where the bank have called on a Personal Guarantee, they'd need to take further action specifically against the individual guarantor to register a personal CCJ for them, which is easily avoided if the Guarantor engages with the bank over repayment.

Trying to get confirmation of is will a company that is recruiting me, look into my business finances or do they only do checks on me personally ( if that makes sense) Or if they find the CCJ through checking my business stuff, because it's not against me personally would it be over looked, seeing that the debt isn't held against me as a person

Head of debt? You need to find out what your credit score is like. If you are going in to a senior position within and FCA registered company you will be thoroughly checked out.

what Industry? Central govt would possibly involve developed vetting where they go into everything including relatives. Security clearance would just be into you.

anything in a regulated organisation such as financial services would almost certainly credit check you.

which is why we need to know WHAT SORT OF BUSINESS IT WAS
