Maternity notice period

Hi all,

I’m having some issues with work and wondered if anyone can help.

I handed in my 1 months notice last month so was expecting to receive 1 months worth of full pay for my notice period and my accrued annual leave. The months notice period would be between weeks 46 and 50 of my maternity leave.

It’s pay day today and I have only been paid my annual leave. Work have said they don’t need to and wont be paying my one months notice because I didn’t work it (as I’m on maternity) and my contract ended at 39 weeks….

I have worked there for 6 years if that matters.

I’m pretty sure this isn’t legal but not 100%! Does anyone have any idea? I’ll be contacting citizens advice tomorrow but don’t really know where else to go with this.

If you’re on maternity leave are you being paid full pay? What month of mat leave are you in? They’re right - you’re entitled to be paid your accrued annual leave but you’re not entitled to full pay if you didn’t work the month

Sorry I misread your first bit. You’re in the unpaid bit of mat leave, you’re not entitled to full pay

Assuming your statutory notice is 2 weeks or more, then no, you are not entitled to the pay as you are in the unpaid part of maternity leave. They owe you your annual leave pay, but that's all I'm afraid.

They'd only owe you a month's pay if you went in and worked, surely? Imagine that instead of leaving you were going to return to work after a full years maternity leave - they wouldn't have paid you for wks 46 to 50 in that situation, so this is no different, I would have thought?
