Occupation order

I have been kicked out my house and husband has applied for a non molestation and occupation order. I went to court last week to oppose the orders and am back in court next week. I feel sick. My 4 children live there. I should live there. Hes claimed 26 years of verbal and physical abuse with 1 police report of breach of the peace in july off me saying I'm fed up and May's well not be here anymore. I feel physically and mentally drained. Do you think I'll get it overturned as his statement is baseless. There never was harm or abuse. Just 2 adults separating and one of them wanting me out and to hurt me.

Probably not, as to be worthwhile someone would need to look at all the statements. Get yopur case written down in a statement and argue your case in front of the judge. Or better still get a lawyer to do that for you if you can afford one.

Who has kicked you out of your house? He cannot do that unless he already has an occupation order. Occupation orders are extremely difficult to obtain, and if what you have said is true it is highly unlikely he will be granted one. Move back in and start the discussion of how you can peacefully separate. If at any point you feel threatened, or he attacks you, call the police. If you cannot get into the house, call a lock smith, its your home too.

We are in court on Wednesday and yes hes going for both orders off lies. I've wrote a witness statement. Hes claiming all sorts. There was no abuse. Just end of a marriage. I'm not allowed into my home unless judge says on Wednesday. So heres hoping justice is done.

So he never got the orders. Showed himself as a liar in his statement. Feel relieved.
