Help please

NC for this and trying not to give too much info as very outing to people who know us.

Background - Working for same company but in a new area/division which required ending old contract, starting a new one (no change in role) just meant changing division paying salary and new payrol team. Pay day was 31st August, still not been paid. Apparently first issue was 3rd party payroll loaded bank details incorrectly. Pay was put through again but payroll said they may have missed the cut off so pay may not go through till next Tuesday (meaning 7th sept). To me that’s 5 working days late. Was reassured it would go in Tuesday but it didn’t. Escalated to manager who said they meant would go in Tuesdays pay cycle meaning paid Wednesday (6 working days late), still no pay. They are saying their policy allows them to pay up to 3-5 working days late and because of the initial error their policy reset after the initial mistake and 5 working days is tomorrow.

It dose not make sense to me, how can they not pay someone for all this time, I thought legally someone had to be paid in their pay day. I get mistakes happen, but I’ve never known a company not to be able to fix a mistake and have an employees pay in their account by the next day.

Company not in financial trouble.

This is really stressing me out. We were lucky I’d been saving to book Xmas activities for the dcs otherwise we would not have been able to pay mortgage and bills. Now I’ve spent the money I saved and missing out on booking activities, I haven’t been able to pay for clubs, if I don’t pay soon dcs will be kicked out. We have extended our overdraft but thats almost gone and we have payments needing to go out too.

Any advice welcome

Try giving ACAS a ring for options. Someone is messing around here...

Contact payroll and ask for and advance of salary today via CHAPS. They can then do a recovery via payroll on the next pay run.

No response from HR, they don’t have a direct number only email and IM.

@Seemslikeaniceday done that already. Pretty much emailed Everyman and his dog. Direct manager working overseas at the moment so working on a time difference, he’s pushing too.

ACAS have said to notify HR we are starting early conciliation. Did that first thing, still absolutely no response from anyone.

Not office based, only offices are at the other side of the country so can’t even go looking to find someone to speak to in person.

absolutely pulling my hair out and so stressed right now.

Email again and state you will be claiming for financial loss due to not being paid on time.

Do you really not have a single phone number of anyone in HR or CEOs secretary’s number? Find any one Senior and phone them and ask for Head of HRs phone number.

Absolutely everyone has been emailed, 3 emails alone this morning. No response to any emails or requests for advance on pay or anything, completely unprofessional. It’s just complete radio silence.

No one has telephone numbers, I’m not even sure the people handling this are direct employees for third party contractors.

Sent all ACAS forms.

Ive never in all my years working come across anything like this. Every company I have worked for would have had this sorted in 24 hours, we are on day 13 now. I thought we would manage till the end of the week but just had 2 unexpected (completely forgot about) payments go out so now we have enough to last a couple of days. DCs are due to go on a whole school field trip this week but we can’t even afford the bus fare for them now or pick up my prescriptions.

I grew up poor, even made homeless as a child, I never expected to be in this kind of position ever again. We moved recently exhausting all our savings otherwise things would have had a back up, not that we should have to need it. I just want to cry.

@Lunaloud I’m so sorry for your situation. I completely agree this could have been resolved with an advance of salary within 24 hours.

The only other options I can think of are to phone your bank and request a temporary overdraft/increase in overdraft. Explain the situation and that you will repay asap. The other option is to apply for universal credit and request a budgeting loan.

Sorry you are still having to deal with this. All I can suggest now is you keep at it every day, until you get a response. HR, head of payroll, your manager etc

Can you contact your old payroll team to see if they could help?

Do you have a credit card you could request a cash transfer from? They’re usually quick. It will cost you, but you should be able to reclaim that cost from the company.
id be camping out on HR doorstep if I’m honest! Tell your manager you’re out of fuel and can’t come to work tomorrow for the foreseeable..?

@puffylovett everything is remote WFH, so no excuse not to turn up to work, well other than not being paid… closest office over 200 miles away, never actually been to as started job during lockdown and been WFH from beginning.

Dont have credit cards but extended overdraft when pay first didn’t go in, can’t extend it again.

@WaveyHair old HR can’t help, cost centres, who is paying salary etc…

One of the HR managers emailed yesterday to say pay would definitely be going in today, it’s definitely all being managed by a third party vendor as they said they are investigating their handling of this.

So far nothing but in past it was be late morning early afternoon so will have to wait a few hours.

Yay it’s been paid, so relived.

Will definitely be requesting compensation but for now just happy we’ve got some money.

@Lunaloud I’m so please for you. I can only imagine how worrying it must have been for you.

Definitely go for compensation for any financial loss e.g. overdraft charges.
