How do I find out about stamp duty?

DH and I live in the house I bought.

DH is still on the mortgage of his old house with the mother of his DC. The youngest DC will be 18 next year - DH is trying to get off the mortgage but his ex isn't cooperating so we're probably going to have to go to court.

He hasn't lived in that house since 2009 so it is definitely, very clearly not his main residence. If we sell my house and buy a new one, will we still have to pay the second home stamp duty?

How can I find out for sure? Do I ring HMRC?

If you are selling your home and buying another one on your name solely then I don't think there is second home stamp duty. However if you are buying a house jointly with your partner and he is on the deeds as an owner of his marital home then there may be second home stamp duty payable. He needs to be removed from the mortgage and the deeds for that previous house.

That is my understanding after a brief Google.

Thank you. The law changed recently so I'll have to pay the extra SD even if I buy alone, because we're married so we're seen as one unit.

I know SD applies for second homes but NOT if you're replacing one main residence for another - but I need confirmation!
