We have tenants on a periodic tenancy (1 month notice period) where they have unfortunately split up. One tenant has given written notice to end the tenancy and has already moved out.
We are concerned (for various reasons that I won’t go into here) that the remaining tenant won’t move out when the notice period ends. We have had initial legal advice and been advised to issue both a section 21 and a section 8 notice for eviction (the latter due to anti social behaviour affecting other residents nearby).
I’m just collating the paperwork and realize that we didn’t clarify with the lawyer we spoke to as to whether the tenant that has moved out should be named on either of the eviction notices, or whether they would be at all liable for any future costs if the other tenant doesn’t move.
Morally I don’t think we would like to include them, as they have been very upfront and honest and not caused any issues, it’s just the remaining tenant that is a problem. However, I am nervous about making sure we do the paperwork correctly and have the best chance of getting the flat back as soon as possible.
