Speeding fine issue

Recieved a letter from hm courts and tribunals services historic fines dept. With absolutely no context, no description nothing, just that I had to pay £815. As my local police had been trying to contact me. I had nothing.

Upon contacting them they said it was for a speeding fine on 1st November 2021.

I moved on November 19th 2021 and had mail redirected for 3 months.

It's taken until now to get any knowledge of this and when I spoke to HMCTS they stated it would need to go to court to be rescinded. But it they find out I'm "lying" there will be a custodial sentence. All this from nothing!

What's the best option? I'd jave paid it if I'd known.

You will need to make a statutory declaration to the court saying you were unaware of proceedings. Which address were they all writing to if this is the first you have heard about it? Make sure the court have all you up to date info and then when the case is reopened you can address the speeding matter

Did you change your log book
if you didn’t then that would be the reason you didn’t get the NIP - notice of intended prosecution

if you did do that and you did mail direction
make sure you have proof of this of when you did it and got his long to show that you did everything possible to ensure you would get your mail and you have no idea why you didn’t get any letters.

also go to check my licence and see if the points are on your licence and what code it is

basically you didn’t reply to a speeding letter asking who was driving .
so it goes to court and in your absence your fined and points put on your licence

There is a time limit for issuing a NIP. It might be worth asking for a copy of the original and any subsequent correspondence.

I was once told Government letters were not forwarded as part of a mail redirection and would be returned to sender

This came from a staff member at dvla when I was trying to get a duplicate car log book
