Hi guys... Just looking for some advice, myself and my child's father has had our first court hearing. He has stated he would like over night stays I do oppose to this as he smokes cannibis, I put this down as one of my concerns as I do not want our child potentially being exposed to drugs or drug use. Child's father has admitted to smoking cannibis not daily but at times to help him sleep... What do you think the Judge would rule for over night stays?

Is he having unsupervised contact already?

Chantelle2019 · 31/05/2022 23:38

@pastypirate yes only 3 hours 2x a week at the moment.

Honestly they are unlikely to preclude overnight contact on that basis.

If you're in court and it involves a child cafcass will be involved, what did the cafcass report recommend? The judges normally follows the report

Caffcass will not want weed around a child! How oLd is the child? If he’s doped up how he can look after the child if the child wakes in the night!

Smoking weed is not in itself a reason to preclude contact.
have you ever smoked cannabis? 'Doped up' sounds like you're picturing a heroin user.. most people can function just as well after a small amount of weed as they can with alcohol.
cafcass will probably recommend he goes to a substance misuse service and sign an agreement not to smoke around the child.

the mental health issues are a further concern which I can't comment on given I know nothing about what that entails for this man.
