Hi all. Got my nisi, just need to apply for the tenancy of my housing association house to be transferred to me from what was a joint tenancy.

Ex refuses to attend housing association office to sign himself off tenancy and housing association won't remove him without a court order.

Happy with statement, followed criteria of circumstances, Housing need (3 kids and he's already been rehoused), non mol and occupation (permanent) in place (dv) but I'm not sure what to put in the boxes on the form.

Obviously names and addresses fine
What goes in the box 'for an order on the following terms'?

And 'the court has jurisdiction on the following basis'?

I can deal with the rest.

Can't afford solicitor, am disabled and nhs band 3 and only get £30 a month maintenance so doing the divorce myself.

Hoping to get it lodged before the Bank Holiday to avoid holding up the absolute....

"for an order on the following terms" is where you say what you want the courts to order. In this case you want them to order a transfer of the tenancy into your sole name, so something like "Transfer of the tenancy on (address of property) dated (whenever) into my sole name".

"the court has jurisdiction on the following basis", just say that the property is in England and Wales.

Whay are you applying under the MWPA rather than just filling in a Form A and doing it under the divorce?

No finances, no child arrangements (he's abandoned them, won't speak to or see them and one is already 18 with a mither almost there). He's on UC and staying on it so he doesn't have to pay more than £30 Child Maintenance.

It's literally just the transfer to be done, the judge that awarded occupation and non mol orders said to do this but can't understand why HA won't accept a permanent occupation order and non mol to take him off.
