We have had the unfortunate pleasure of using a builder that continually lies, never turns up and now has our money of the sum £14,000 for a roof that hasn’t materialised. The builders are a limited VAT registered company, but for some reason we having paying the builder into account that is not VAT registered. The stupidity on our part is that we didn’t receive an invoice but the original breakdown payment schedule added VAT to our payments. So basically I think we have being paying VAT into account that is not VAT registered. Where do we stand ?

I’m having trouble understanding - bank accounts aren’t VAT registered, companies are.

As the amount is over the small claims court limit you will have to go down a more formal court route - you need professional legal advice.

Notagoodtime, sorry to hear the trouble you are having with builder. I don't know much about VAT but can you clarify if you are asking him to return your money? Did you pay him a one off transfer to his bank account?

What do you mean about the VAT? What you have posted doesn't make sense

You should be paying into a bank account that is linked to the limited company. You should be able to tell this when you set up the payment with the bank.

If the company is VAT registered then they deal with the VAT payments to HMRC
