Hi ds2 is 15 going to be 16 dec. He’s not seen his dad for about 8 years now. Dispite him promising to come up once a month. But I’m wanting to know if I can change his last name to mine.

Depends if the father has PR. If he does, you need his consent for a change of name. If he doesn't, you can go ahead. Once your son is 16 he will no longer need his father's consent for a change of name.

What does DS want? It’s his name, not yours?

If his dad has PR you cant change his name without his consent. Your DS can change it himself when he is 18

We both have PR as both names on birth certificate. But he’s not botherd with him for years. Ds2 is nonverbal.

If your DS can't consent then there may be issues with trying to change his name. I assume the age is 16 so they can have a say in the matter.
