Hi there I need some advice, my child's father is taking me to court his reason being on the court papers are because I keep refuseing and then resuming him contact with our child and also changing the agreed arrangements, this is not the case, I have not refused contact nor changed arrangements I have all emails and messages between myself and my child's father to prove otherwise. My childs father is the one that decides not to see our child when he feels like it and is very inconsistent. What do you think the Judge will say to this or what would the judges view on this be?

A court order will make things clearer, written down in black and whire. Of course it still doesn't mean he won't cancel . As you aren't refusing access you can agree reschedule and give the judge an easy case.

Have you been through mediation with your ex op? If not, then the CAO application may be premature. The judge will expect mediation to be at least attempted before you go to court. If you can get a written agreement for child contact that is agreed through mediation. Then court could be avoided. If the agreement is not kept to by either party then either of you could then go to court to make it a legally binding arrangement.

The childlawadvice.org.uk website is a good resource and you can call the helpline for advice.
