Who prepares a 'position statement' in Mediation

Mediation in our inheritance act claim is booked and we have received The agreement from the mediator to sign. It has a short run down on the proceedings and mentions the position statement for both parties.

Does our solicitor write this statement or do we?

The solicitor/barrister. Best thing to do would be to speak to your solicitor and ask them to talk you through what happens in the run up to mediation/on the day and they can answer any questions like this.

You may prefer to get your solicitor to draft it but, if you feel confident and want to save money, there is nothing wrong with doing it yourself.

I think we will do it ourselves and then pass it on to the solicitor to tidy up and trim it down if necessary. We are pretty clear on it needing to be an outline of the case as we see it, and know the other side will see it. There's lots of online information on what is required, and if it saves a little bit of money, all good. I also think the best people to write it are the people/person involved, so I'm pleased it is an option.

FWIW one of the responses we had was not much to do with the legal issues and we had asked for it to be email between the parties, which our solicitor agreed with. When the defendants went via their solicitor we completed our response using 'our client' instead of 'me' to save costs and our solicitor copied and pasted most of it as we asked her to do. She was happy with it and saved her time and energy on unimportant matters.

@poblwc We will be having a conversation around the mediation format and what we need to provide for the bundle (if anything). We have some suggestions but will leave it up to them to make the final decision and decide on tactics. Need to ask if we should do a private statement for the mediator outlining the bottom line on movement in the case, so lots of questions still.
