Narc ex refusing to sell home jointly owned

My narc ex is refusing to sell our home, I have offered to buy him out, sell the home or for him to buy me out, I’m coming out with a quarter of the equity where as he is coming out with three quarters of it and we jointly went halves and paid half the bills, I’m only taking this is due to the abuse and threatening to live there until he’s dead. I’m pregnant and currently living with friends and have a young child from a previous relationship. He is so abusive and caused me so much stress and I nearly had my children taken away from me because he’s such a danger. What can I do? I feel like he’s not even bothered about the money and it’s all about the hold on me because he’s getting so much more more from it then me and he’s purposely not doing anything about it.

Were you married? Is the house in joint names?

Flowers2622 · 01/02/2022 02:02

@prh47bridge not married, the house is in joint names and I have a solicitor involved who’s confirmed I have rights to half and willing to accept a quarter if taken off by a certain date, he has agreed to all this but has now shown he’s just avoiding doing anything about it knowing I need a house before the baby is born and knowing I’m spending money every time the solicitors send him an email.

Get an Order for sale under the Trusts of Land and Appointment of Trustees Act. Ask the Judge to make an order that you have conduct of the sale and for an order that he pay your costs. I think, if push comes to shove, you can also ask the Court for an order that the Judge sign the papers on his behalf.

Do you own as joint tenants or tenants in common?

I read about a case where the court eventually had to order the occupying party to leave the house so it could be sold because she had frustrated court orders for so long. She re-entered the property again and got a custodial sentence. The courts take this seriously.

And that is where I think you need to go and take half so you can cover the legal bills. He's a bully and needs to feel the full force of the law.

I am going through the exact situation currently. Have got solictors involved and agreed to sell, now ex narc is delaying it by refusing to make a decision on who markets the property. I have spent thousands in fees already and it’s been 6 months with little progress @Flowers2622 it would be interesting to know what happened in your case. I hope you are ok.
