What will happen if I tell the tribunal I can't continue? My worry is past employer will pursue me for their costs.

Thanks for replying @Yummypumpkin I'm self representing, and the impact on my health is overwhelming. The tribunal is about discrimination due to protected characteristic of mental health.

Oh that's so sad when you must have had a battle up to this point.

I'm not a legal expert so it's not a good idea for me to speculate on how best to handle it.

The circumstances in which costs are granted are at Rule 76 of the Tribunal Rules assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/1032803/consolidated-rules-october-2021.pdf

Either you fall into one of those categories already, or not. The mere act of withdrawing your claim won’t put you make it more likely costs would be awarded.

You would just email the tribunal and other side saying you have decided to withdraw your claim. That’s it done.

Costs are pretty rare in employment tribunals but awarded as per rule above. Have they said that they will pursue you for costs? Best of luck op - it’s difficult to fight these things
