Amending a Child Arrangment Order

Hi all,

I was wondering if anyone knows how to go about amending a CAO?

We have one, but circumstances have changed which means that DS spends less nights at his every month. He is now relying on this to pay less than what he should for maintenance

I have text message evidence about the informal change and I've submitted it to the CMS. However, I think I will ultimately have to change the CAO.

Does anyone know how you do this? I've looked at a C100 form but I'm not sure if that's just for a new application or to amend an existing one.

You can apply to vary the existing CAO using form C100.

It's a very backwards system where an outdated court order takes precedence over everything!

It doesn't need to go back to court if you're not bothered about changing the order but seeing as your thread is entitled "amending a CAO" a blob of tippex isn't going to cut it.

It depends on the evidence the CMS take in to account. If they say the order is paramount then back to court you must go, but a consent order is far cheaper than a contested application fee so it depends if he will cooperate.

He won't co-operate at all. He won't even speak to me so looks like it will be back to court we go Sad

The system is so flawed. He gets a court order, reduces contact and pays according to the order.
