Can I ask if you need to take someone to a small claims court in Scotland do you need to provide evidence as to why and also who makes the decision that you have a valid claim and not a lot of rubbish? Thanks

Yes, you will need to provide evidence to support your claim. No-one will vet your claim to see if it is valid. That is for the court to decide.
