Disclosure? Help!

I am in a dispute with a company and have made a legal claim against them. The company formerly managed an account on my behalf and refused to hand over the financial/account details when I stopped using them.

I have asked them and their solicitor to return the accounts to no avail. (I am representing myself as it is small claims court.)

Can the court make them hand the accounts over? They may be relevant to my case against them.

If so do I need to apply to the Court to do this or do I wait for the "exchange of documents" part of the process. I think this is called disclosure?

Completely lost about what to do (and I can't believe their solicitor hasn't told them they need to hand over my account information!).

Do you need the information urgently? If so you can make an application for just that information without waiting for disclosure (at least you can in other courts - I'm not familiar with small claim procedures).

Thank you @eurochick. Do you know what the application is called, or does the process have a name, so I can Google it? I have absolutely no idea! Blush

@TillyTottenham as I said I am not familiar with small claims but in other courts you would need a form called an Application Notice. You say what you need and why, and submit it with a fee. There are some posters who deal with small claims matters who might be able to tell you if this will apply. Good luck.
