Was this a safeguarding failure?

When in refuge was getting housing benefit for home flat. Council wrote to home address asking if was still in the refuge. They had refuge address and email address and had been asked not to write to home address. Ex could've seen the letter. They knew if still in refuge, wouldn't get the letter so shouldn't have sent it to home address anyway but was it safeguarding breach?

I'd say unequivocally

Absolutely a GDPR breach which could have had a significant impact on your physical safety.

Thank you so much for replies. Does anyone know if I can do anything about this. I'd be really grateful. Local legal advice place wasn't interested but maybe because funded by the council. Can't say too much but I'm still not safe and being pushed to go to the council but I don't trust them after what happened. Frightened after what happened.

It's terrible, but iirc, as long as they have that address on file for you, they are in the clear to be sending you things to that address even with the "please don't send things to this address" which is just a request and not as legally binding as their being within the GDPR guidelines by sending mail to an address they hold for you. The content of that mail may or may not be relevant.

you could ask to speak to the manager of the section that sent the letter .

I would be interested to know how you get on.

So far:

  1. My ex's Solicitors forgot to redact her address from medical evidence (despite claiming I am a monster).
  2. Social Services have left her address on the Section 7 report.
  3. Family courts have sent out documents with her address on it.

I have written back to her Solicitors and Family courts to say I am worried about actual perpetrators getting addresses. Didn't bother with Social Services as they know the situation.

Unfortunately I suspect this happens all the time and someone is going to end up in a compromised situation down the line. I have not heard back so just hope someone has done something!
