Employment/redundancy question

2 replies

honkytonkheroe · 05/04/2021 19:05

I have completed 7 years of employment towards the end of April. If I accept voluntary redundancy now, would I get the extra year by the time the month notice has been given (I assume that this gets given as i would have to give a months' notice to leave?) or would the calculations start from when I accept and therefore just be 6 years?

@honkytonkheroe
When an employee has been made redundant without the statutory minimum notice to which they are entitled, including where a payment is made in lieu of notice, s.145(5) states that the relevant date is the date on which the minimum notice would have expired had it been given. So if the month notice period would have taken you into an additional years service that is what should be awarded.

Excellent, thank you.
