Counter non-mol. Any advice?

It’s a very quick ? My ex h has taken out a non mol which I contested. Had a hearing, judge refused to apply non mol until final hearing, no undertakings. My ex h, I believe wanted this in place before a final hearing on a child contact enforcement order. He is trying to portray me as unhinged and mentally unstable. After some though I wondered why I shouldn’t take out a non mol? I’m scared of him, he has been physically abusive, I’ve moved 100 miles away from him and he still uses my family to control me.

Can I take out a non mol?

Its unclear what you're asking for.. So he has asked for a non molestation order to be served onto you and now you want one on him? I think it's highly likely the judge will just ask you to do cross undertakings which is both of you promising to the court you'll leave each other alone.

You can cross-apply within his application, but I would suggest you speak to a solicitor first.

Have you put details of his conduct in your statement?

Thank you, I haven’t written the statement yet. I’m going to try the women’s advice line at 7. Can’t afford to go to a solicitor.

No I’m not. Just want some advice, I guess this free half hour thing is just a myth!

You sure about the legal aid? You should be as a victim of domestic violence.

Everyone is eligible for legal aid to get a non mol. The terms are not always realistic. What makes you say you are ineligible?

The actual non mol application is free, it’s whether it’s the right thing to do and implications on the application he has made and current case that I need advice on.

And legal aid would cover that.

And "half hour free" is indeed a myth.
