HELP AND ADVICE NEEDED

Hi, I need some advice anything will be helpful and if there are anyone in this field of law I would appreciate it a lot.

My friend and her husband were married in Bangladesh in 2009
Spouse arrived in the uk in 2009;
Been separated since 2012;
Spouse obtained citizenship on the basis marriage was subsisting - 2-3 years ago;
Marriage not registered in the uk at all;
No children
No assets
No money
Separated because they didn’t get along.

What would my friend need if she contacts a solicitor. What documents proof? How much will it cost? What legal drafts or forms need filling up based on the above?

Please help me as she is in despair and all alone during lockdown and feel that she is getting depressed and really wants for this divorce to be over and done with.

She needs to see a solicitor who deals with family law. The solicitor will tell her what documents she needs and the costs involved. She may be able to get an initial free appointment.

Should be a simple divorce based on 5+ years of separation so can't be contested.

Evidence will be separate addresses for the time period.

Even though there's no money it's ideal to agree a clean break so neither can come back for money in the future.

It’s a marriage certificate from Bangladesh which has already been translated. She hasnt registered the marriage in the UK at all or claimed any joint benefits with her spouse. The only thing she did is hang about until he got his citizenship.

My understanding was that if the marriage is not registered in the uk then how can she issue divorce proceedings here? Also what relevant form will she need to complete?

Your understanding is wrong. It doesn't matter where the marriage was registered. Provided her marriage is legally recognised in the UK and she lives in the UK she can get divorced in the UK. Marriages abroad are recognised in the UK provided the correct process was followed in the country where the couple married and the marriage would have been legal in UK law.

If she is seeing a solicitor, she won't need to complete any forms. Her solicitor will deal with that.

So he got his Citizenship illegally as they were separated?
