I co own a property with my partner which is mortgaged. We have two children together who live in the house.

Someone is trying to sue him for pretty substantial damages. Could they come after the house in these circumstances?

Not directly but they could apply to have your partner made bankrupt. If that happens the house may have to be sold. However, as you are a co-owner, you would be entitled to 50% of the proceeds. It may also be possible to delay any sale to give you time to make other living arrangements.
