Joint property and Divorce.

I hope to get my Divorce this year, I am representing myself. . I am to live in the house until youngest 23, then we sell and split 50/50. We have joint mortgage and joint ownership. With a divorce does half the house become my estate. I am worried that if I was to die that the house just becomes his. On my death I would like my half to go to my kids as I have children outside of marriage. So I guess my question is on a Divorce my stbxh doesn't get my share of the house.

If you hold it as Joint Tenants you simply serve a notice of severance. You each then hold an equal share as tenants in common. You then need to make a will dictating who your share goes to, as if you die intestate he would get your share.
