Executor no longer wishes to be - what to do?

Long story short, I am (with my previous consent) named as executor in my dad’s will. I learned today something that has made me change my mind.

Obviously I’ll talk to my father but I need to have facts. Is it a job I can refuse to do when he dies, if he doesn’t agree to change that part of his will?

I'm sure a legal expert will come along soon, but I believe you can resign as an executor. Would be better if you're not named in the first place, I guess.

But you will get comments that your dad is entitled to leave his stuff to whoever he pleases, which is true.

You can ring your local coroner court. My brother turned into a total nightmare (I had no idea I was joint executor). I rang the coroner court, very helpful, made an appointment and had him removed as executor.

I think you can also remove yourself as executor.

Coroner court is very friendly and helpful.

You cannot be compelled to act as executor. Even if your father refuses to change his will, you can renounce your role as executor when he dies. That means you give up your role and responsibilities as executor completely. If you go down that path, make sure you don't do anything that could be considered as the executor's responsibility before you renounce. If there are other executors, they can administer the estate. If you are the sole executor, the beneficiaries of your father's estate will have to decide who they want to take over as executor.

Dad can do what he wants with his money, that’s not the issue. Too outing to go into!
