Desperately need some advice freaking out !

So about two and a half months ago I was turning into a one way road, where couple of pedestrians waited for me to go. As I moved forward to turn into the road a lady came from behind the man that was waiting and without looking started to cross the road, i did an emergency break, and told her to watch where she was going, at this point she was already in middle of the road, it’s a very small road. She then walked back to the pavement and I drove off. So now I get a letter from the met police traffic enforcement saying I hit a pedestrian with my car. From what I recall I did not hit her with my car, and in no way did she attempt to flag me down, or stop when I breaked to tell me I hit her, she walked back to the pavement, I didn’t see anything happen. I spoke to the case manager and told him I didn’t hit her, she walked back to the pavement, didn’t attempt to even talk to me or try to stop me, when I told her to watch when she’s crossing the road, he says he has cctv footage, i said ok that’s fine. I do not recall bumping her with my car and no way did she make it it clear to me that I did.
I was just wondering how much trouble would I get into for this? I didn’t even know my car bumped her and now I’m being accused of not exchanging numbers and careless driving.

I would speak to a solicitor and ask *@MNHQ* to remove this post. It's very specific and you've said a few times that you may have hit her. You need legal advice and to have this thread deleted

I read it not that the OP thinks she hit her but like anyone in this situation her mind is questioning her own memory. That's a normal reaction imo not an admission of guilt.

OP someone hit my so last year - very minor bump - police weren’t interested

Slight scrape on his car due to bike pedals, no injuries

Nothing was done

Have you spoke to your insurers yet ? They will provide legal representation you won't need to find a solicitor yourself.

It depends on the specific policy wording but generally speaking it's unlikely that insurers will provide legal representation, this is usually discretionary and especially where no injury claim has been intimated it would be unlikely they'd exercise that discretion.
Legal expenses cover under the policy may assist, typically this is limited to bringing a civil claim for injury or damage rather than possible criminal charges though again it will depend on the wording of the policy.

Keep your statement as short as possible.

“On the XX as I was pulling into XX road, a one way street, I noticed several pedestrians waiting for a gap in the traffic to cross. Another pedestrian was paying insufficient attention and stepped off the kerb in front of me. I performed an emergency brake manoeuvre. She stepped back onto the pavement apologetically. I continued on my way.

For the avoidance of doubt, at no time did my car make contact with the pedestrian”

Any further detail can be added later.

Thank you everyone for your opinions and views, it honestly really has been very helpful. Let’s see where this takes me.

I was wondering after I send my statement off and they say I’m guilty of bumping the lady can I ask to see the cctv footage?

If they find me at fault I think the pedestrian should also be at fault. Getting blamed for driving a car without care. The pedestrian should also be acknowledged for crossing the road without car.

I expect they've had one of those calls about 'you were recently involved in an accident' and saw pound signs.....

I'm not sure about ringing your car insurance yet - a friend rang to report a possible claim once and although nothing came of it, he lost his no claims. Just a thought?

The CCTV footage - if they have anything - could be really unclear and not show anything in enough detail to support either story. Just stick to saying the truth - you didn't hit her. This is borne out by the fact that she walked back to the kerb without saying anything or reacting in any way. Good luck!

If they want to take you to court they have to show you the evidence on which they intend to rely so yes, you will be able to see the CCTV footage.
