Divorce - buying out

Hi all

I had my solicitors meeting a few weeks ago and I thought I understood but now i am so confused.

Ex-OH has agreed to agree on consent order. I am buying him out. He is currently in the property im buying him out from.

He has found a house he really likes but he can’t make an offer because he hasn’t got a deposit from me. Which obviously I won’t do until it’s all agreed.

But equally I don’t want to allow him to stay in the house once deposit has gone through. It won’t give him any incentive to leave ? I just wondered if someone could clarify the position for me please.

I have filed the petition.

And make sure there’s something in the order about him agreeing to vacate as soon as the payment has been made.

Thank you both. That makes a lot more sense to me now.

So essentially the estate agent would need both mortgages in principal (mine and his?)

No. Your lawyer just needs to know where to send the cheque/money transfer.
