My ExH and I have been divorced for 3 1/2 years. He has since remarried and is now separated. Until March this year, he only had the Children EOW, am extra day in HT, a week at Christmas and Easter and two weeks in the Summer.

In lockdown he started a Residency case for the Children and retained them for seven weeks. This is on-going through the Courts.

Three years ago, he defaulted on the mortgage he had continued to pay. I ended-up in Court (we jointly own it and he never turned-up) and, having got a job, took it on. It was about half my take-home pay.

The house is the only asset we have. He earns at least 3xs what I do and has rented a house big enough for the Children. I was out of the jobs market for 11 years and wouldn't be able to raise a mortgage on my own.

Can anyone shed light on the likely split of the equity he he gains Residency, or, if I do? What if I remarry?

I know I will need specific advice, but I wondered if anyone could help.

TIA.

  1. That is far too little information for anyone to advise.
  2. Go and take proper legal advice from a solicitor.
