Selling share of property

My parents own a house together as Joint Tenants. My dad does not have capacity. Can my mum sever the joint tenancy and transfer her share of the property to me? My dad obviously could not sign anything and it would just be her share.

She'd be extremely unwise to do that, and so would you.

CGT. Inheritance tax. Care home fees. You and she could come a cropper on the lot of them.

Whether she has power of attorney or not, this would be most unwise.

The power of attorney is supposed to act in the best interests of the person they have POA for. Depriving them of their assets is not in their best interests, second guessing what they might like to have done is not the role of the POA.
