Hi

Me and our ex decided awhile back now that we wanted to change our son's middle name. We are currently going through a divorce.

Anyways last week he told me to go ahead with the deed poll stuff and we both agreed a day and time to sign it infront of a witness.
He has suddenly decided he does not want to sign it, doesnt agree to the name change etc.

Just wondering if i need to inform the deed poll office again because they mention how its a legal name change etc..sorry if that sounds silly.

Does ex have parental responsibility eg. is he named on birth certificate? If so, pretty certain you cannot go a head with the name change if he did disagrees. Likely they will require everyone with parental responsibility to sign.

You don't need to tell them

You don't need to contact a deed poll office.

If he won't sign then you can't do it.

Just to avoid confusion for others
There is no official deed poll office - but there is a private limited company that calls itself the deed poll office which charges to produce documents. You can use the template documents on gov.uk for free.

There are some circumstances in which it is useful to "enroll" a completed deed at the Royal Court - this is something different from the deed poll office - to enroll you have to send to the Royal Court the completed signed documents - they do not produce them. There is a charge for this.
