Hello, can anyone give me some advice?
My child’s father got a 9 year prison sentence for a brutal attack on myself which almost killed me.
My child was present and in court an indefinite restraint order was given to him. This was to not contact, myself, family directly or through any third party.
I am hoping to have his name removed from the birth certificate and parental responsibility etc to be annulled. My child will be 13 yrs old when he is released. I have to put exclusion zones in place to keep him away from us all.
My fiancé is hoping to adopt my child and we need to know where we stand regarding this.

You can't get his name removed from the birth certificate. A father's name can only be removed if he is not the child's biological father.

The courts are reluctant to remove PR but, given that there has been serious domestic violence, you may be successful provided you were not married to him at the time of birth (assuming you are in England or Wales).

Adoption without the father's consent may be possible.

You need to get proper legal advice.
