Hi all
Currently facing redundancy which is in consultation at the moment, they have released guidelines on how it will be decided
One of these being around sickness
I have previously had time off (signed off by doctor) for anxiety and stress due to heavy workload and basically the company being shits to me which lead to a breakdown, had a few incidents since then where mental health has been poor but no more than 3 occasions all 1 or 2 days, not been signed off again.
Can they use this against me in redundancy talks?
They have mentioned the equality act is physical and mental illness but they haven’t confirmed any more about that

They can use your sickness record in their decision making. However, they have to be careful that this isn't disability discrimination. They should therefore discount any sickness related to a disability.
