Contact hearing but already had contact !

Hey...anyone been taken to court for contact when it already takes place?
Essentially has her every other weekend and a night in the week. Wants to extend it by basically having 2 nights a month extra. Didn’t discuss it before applying.
Eeek...what a waste of time, how would the courts view this behaviour?

Courts may get frustrated or may not. Depends if this is first time or tenth. Also, if you are in agreement to it it can be a very quick process and just formalises the arrangement with a document to stick to. Only thing I'm confused about is there is supposed to mediation prior to any court application except in the case of domestic abuse.

Not quite. Mediation is not compulsory. The applicant must attend a Mediation Information and Assessment Meeting unless they are exempt. Domestic abuse is one of the exemptions but it is not the only one. Having attended the MIAM they can refuse mediation.

@lilypoo12 - Are you happy for him to have the extra contact he wants?

I don’t mind the extra contact but not in the format he has suggested as it would be lots of toing and froing. He wants a tues and Thursday which means she is with me then him then me then him. Would rather the week he wants her twice be consecutive days...other than that, it’s fine.
Was offered mediation but they wanted me to pay 120 per session and considering he hadn’t even spoken to me about it I thought it was a little over the top. Told them I didn’t have that one of money so if he wanted to pay it I would attend.
