Medway family court - problems?

My exDH signed a consent order in March agreeing I can move back to my home country with the DC’s in July.

My solicitor submitted to Medway family court early April with the C100 form. He said it would be straightforward.

I’m now four weeks away from moving and I’ve heard nothing! My solicitor seem unable to chase it up or to get any sort of indication from the court how long it’ll be until they look at the papers.

Has anyone else had any problems with them? Is there anything I can do to make them speed up?

Email the court, but most courts are shut. I don't know. If your ex has signed and agreed the paperwork and not made any objections -go.

I have emailed, they’re open. All they said was:

“Good afternoon
Upon receipt the file is checked and once approved it will be put before judiciary the following day.
It is then up to the judiciary, upon considering the file, as to when it will be heard.

Kind Regards

Administrative Office“

That was on the 23rd April.

They didn’t say anything specifically about my case or give me any indication of time.

Put in a formal complaint. That usually moves things on.

Ah great! I didn’t realise I could do that. Can I do that myself or is it best to go through solicitor?

(Although my solicitor is useless...)

If your husband has consented, in writing, to you taking the children to live permanently abroad, you don't need a court order. His consent is all you need.

Since I posted this in June, I have moved abroad with the letter my ex husband signed.

I have not heard from my solicitor since early July, despite chasing via email twice. They don't even acknowledge my email (I send it to solicitor + his PA).

This is not acceptable, is it? Should I put in a formal complaint, or can I ask them to cancel my case and to refund the money they hold on my account?

Put in an official complaint.

They will have to answer within 7 days and usually produce the order fir you so that they look better to senior managers.

It's now a year on and I've still on heard a peep.

I just tried emailing my solicitor and got a bounce back saying he doesn't work there anymore. No one has informed me of this!? Shocking.

It's September 2021. This was submitted to the courts in April 2020.

I HAVE STILL NOT HEARD ANYTHING FROM THE COURT!

Since you were represented I would expect any response from the court to go to your solicitor. Go to the firm he worked for - someone should have taken over the case.
