Hi all,

Anyone here had an abusive exp get a glowing report for supervised contact but still challenged it in court ? And if so was your challenge listened to?

Hi, we're moving this thread over to our Legal Matters topic and giving it a bump.

I'm a solicitor, so not perhaps the person who you wanted to answer, but the answer would really depend on why contact was supervised in the first place. If it was because you were concerned that he wouldn't be able to relate to the child and he appears to have coped with that very well, a judge isn't going to be very impressed if you still make that an issue. Also, you generally need to voice your concerns at the outset, so you can't just pop up now and say he's got a drug problem so you now want that looking at when you've not mentioned it before (well, you can, but a judge is unlikely to be impressed) .

If the level of supervision was much less than that envisaged by the judge the last time round (eg was expected by the judge to be someone in the same room observing what was going on, but in reality you ended up with someone facilitating handovers only) then that might be something you want to bring up.

@collaborate, supervised contact to re-establish contact but I have raised concerns over previous abusive behaviour to dd but welcomed supervised contact and asked exp to sort his anger issues.

Between two judge's one & cafcass said that such sessions would prove if my allegations are true or not (no section 7 done, they've not looked at evidence and exp said some incidents did happen but I dramatised) in this instance I asked that if such weighed would be placed on it then sessions should take place in a contact centre and section 7 be done also (other party wanted it to be done in a park). Second judge said no it's just to re-establish contact and while there will be a report it's only an observation report and while it'll have some impact it won't paint the full picture. So contact has taken place in a park. She also said she hasn't decided yet is a S7 or fact find needs to take place.

I've not yet actually got the report back this will happen tomorrow, but just wanted to know if I could still raise the fact that regardless of if it went well it doesn't negate the fact I still have concerns and that I have witnesses who have seen some of his behaviour and until they look into this properly and that a proper assessment is carried out.

I think I'm also worried that between the two judge's there is a difference of option on these sessions and when we go back to court I don't want us to end up with a different judge.
