Insurance claim - legal fees query

I am making an insurance claim via no win no fee solicitors for a serious rta that my dd and I were involved in while on holiday. I had holiday insurance that included legal cover that was covered by the same solicitors that are dealing with the claim .

I had a letter from them saying that they would not be deducting any fees because the legal side was covered by themselves under our insurance. They are now saying they can’t find this letter ( and Sod’s law neither can I but I certainly didn’t make it up ) . They have sent a payment for my dd but have deducted their fees . Am I correct in thinking that they shouldn’t have done this ?

This has been dragging on for 4 years now and I’m fed up chasing them .
TIA
