Removal of name on mortgage

ObsessedwithFIFA · 05/05/2020 17:29

I split with my husband over 2.5 years ago and have been divorced for 1.5 years.

My name is still on the mortgage although he has always paid from his account (when we were together).

I've asked him repeatedly to have my name removed.
How do I go about this? Am I still liable for any repayments if he gets into financial difficulties?

Don't want to go hard ball on him but I'm getting frustrated!

You sort it out by either agreeing a financial settlement with him on divorce (and getting a consent order) or taking him to court for a financial remedy order.

Thank you.

On our divorce it stated there was no financial ties between us, so just wondered if I'd still need to take him to court?

Clearly there are financial ties between you as you have a joint mortgage. If there was no financial settlement at the time of the divorce you need to agree a settlement and get a consent order or take him to court for a financial settlement as Collaborate says.

What was the “it” that said you had no financial ties? Was this in the UK or abroad?

It really isn’t as simple as removing your name from the mortgage. He would need to take on the full liability for the mortgage which he may not be able to do due to affordability, particularly at the moment. If there is equity in the house, are you seeking a share? If he can’t remortgage alone and but you out either you will need to buy him out or the house will need to be sold.

If he stops paying this would certainly damage your credit rating too.

This is in the UK @Collaborate

I found a letter from his solicitor saying there was no financial ties between us and the 3 properties were solely in his name.
They are it's my name is on the mortgage for one of them.

The letter has no effect. You need to take some proper legal advice.
