My son turned 16 in June and since has chosen to live with me the majority of the time. At least 70% of the month. He also changed his address at the doctors to my address. When his mother told him she would lose the house if I got the benefit he decided not to change his address at the school and I didnt want to destroy him by demanding this. Because of this and the lies she told the benefit office about how many nights he was with me, child benefit stayed with her. Now a section 7 has been done for my 2 younger children as I am claiming full custody due to many issues. Despite my oldest not being apart of the order he was still Interviewed by cafcass and made it clear he lived the majority of time with me.

My question, and that you for taking the time to read this, is as this is a legal document for court, will the benefit reconsider if I show them this. If not, want can I do in this situation? I have him nearly every night now yet she continues to get all the benefits.
No we cannot in any way discuss this or would she consider sharing benefits

Do your own claim for child benefit for 1 or all of the children. Only 1 person can claim for any 1 child. If she disputes your claim the CB office will decide who gets the money

I did, they decided she kept it. Despite him living with me most nights now. She lied when filing in the form about the nights in the previous 3 months he had stayed there.

You can only show a court document to others (including a state agency) with permission of the court. It's contempt of court otherwise. Given you haven't yet told them your son lives with you I suspect you wouldn't get it. Apply first and see what happens.
