Ex applied for a prohibited steps order

My abusive ex has applied for an prohibited steps order. I moved in with him at 36 weeks pregnant leaving behind my entire support network. Upon some sufficient escalation in his abuse I felt it was best for myself and dd to return to my hometown, I tried to make it work a further 3 times but by June 2019 and some counselling I felt it would be safer and best if I stayed in my hometown with my family and job. At no point did I stop contact between dd and my ex.

Ex has now applied for a pso saying he has fears I’ll move to Dorset, never been discussed as a possibility and no proof of this what so ever, and that he doesn’t want me moving more than 15 miles from my current town. I have no intentions of leaving my current town, but feel he is doing this to further abuse and punish me for leaving him. How should I approach this as I cannot order a solicitor? Will a judge granted a pso without proof ?

Has he actually applied or just told you he has? If there is nothing to suggest you would move i.e. you are near your family at the moment, in permanent housing, have a job, I cannot see a judge issuing it.
You can represent yourself in court, but get some legal advice first. Often you can get thirty minutes free with a solicitor.

What a massive pain in the arse. Unfortunately there's nothing can be done about a vindictive ex who starts weaponising the court system. Mine did that and it drove me around the bend, which is exactly what he wanted.

If he has made an application to court, then all you can do is turn up and deal with it. You can just read out a written statement which might make it simpler.

My ex used to make up all kinds of shit just to piss me off.

The courts are now more aware of this kind of behaviour. You might want to get in touch with Women's Aid to ask their advice.

@delilahbucket his solicitor has written to me to say they’ve applied. But thanks for the tip on the free 30mins

@sicario, oh mine will do the same. Made my life hell while together no idea why I thought it would change now I’ve got out. I’ll give woman’s aid a call tomorrow and see what support I can get.

Thank you both
