So, after weeks of anticipation, preparing witness statements and position statements it's paid off. The grandparents application was unsuccessful. It has been dismissed for my younger Daughter and my elder Daughter will visit for 2 hours monthly as she has been doing previously. No order was made only a vary to the consent order regarding times due to my Daughter starting school. Cafcass did suggest 4 hours but the court didn't think it was in my Daughter's best interests and i agree. I'm so relieved this is over for my kids and myself, i can relax now until next time. Thanks to everyone who has given advice on here and positive messages of support, it's kept me going with seeing this through.

I'm fast approaching final divorce hearing 5 weeks away. Ex of 21 years left 6 months after taking early retirement with a pension pot of 550k also was committing adultery. Almost 2 years on we are approaching final hearing I am keen to stay in the family home having lived there for 17yrs and take a lower share of pension. Ex has spent all his money and lives on 520 a week I have struggled to keep up mortgage payments of 650 a month as I work zero hour contract if house was in sole name mortgage payments would be less than half ! So far he has delayed everything possible refused to admit they are cohabiting. Judge at fdr indicated 50 50 split does anyone know if final hearing judge would consider my option better as in keeping the house for a lesser share of pension. All children are grown up. He has had a 2nd heart attack since leaving and also now bowel cancer although with 5 weeks to hearing hasnt supplied an up to date medical report same as he did for fdr

How will mortgage in sole name be half ?

If you can’t afford it and it’s deemed too big for needs ( eg 5 bed detached and you don’t have dependent children) it would likely be required to be sold ?

Thank you for your reply the mortgage has only 6 years left to run if the house was signed over I could remortgage upto 15 years which would more than half the current payments as I am 7 years younger than him. I have 3 beds a 27 year old son under the mental health and my alcohol dependent brother living with me along with 2 dogs 🤣 he has lied on financial disclosure stating he lives alone yet private rents a 3 bed 3 storey house while cohabiting my point is why should I sell when he is clearly overhoused whilst still drawing a mega pension.

Hey, I'm not sure how your final hearing will turn out. All i can advice from my experience is to approach the hearing sensibly and calmly. The court will listen to you and consider your views. It isn't all that bad honestly just worrying as to what the outcome will be as I know. Good luck x

Thanks. And yes we can finally relax. I'm so pleased that the courts have identified what has been going on and prevented my children from any further nonsense. The worrying thing is she literally threw into some kind of rage after hearing the outcome, so I'm expecting something else to happen real soon as she's told my ex she is appealing the decision! I'm just glad others have seen this side to her so any further nonsense will hopefully be turned away from the courts. Wow lol
