C100...

Mediation appointment today, went ok but then a series of aggressive goalpost-moving messages from Ex...Im now feeling further mediation is pointless and I'm ready to submit a C100.

What happens if we both submit one, and they essentially 'cross in the post'?

Communication is not working at this stage so I can't just ask him "who is taking who to court"

I think it is whoever’s reaches the court first!

Although I’m sure there’s a section about mediation - do you have to speak to a mediator first to get a certificate to confirm mediation is not appropriate?

If the court staff spot they are both linked they'll be listed to be heard together. If not, the one that gets heard first will mop up the second one.

Thank you for your replies! I wasn't sure if this thread would just tumbleweed....
I have submitted the C100 and C1.

had an email this morning from Ex new partner asking if we can come to an amicable agreement before 'they have to initiate court proceedings' so it appears that only one application has gone in.

I responded and told them I am happy to consider any proposal, but would prefer to continue with the court route as this will ensure an agreement is drawn up properly, this was not taken very well.

Now we wait I suppose- I am panicking a bit about Ex's reaction when he receives the forms, but there is nothing detailed on there that is not true.

Oh I do have the form from mediator stating that mediation has broken down.

Yes you have to get mediation to sign the papaer saying you've attended an miam appointment. We paid 60 plus vat for this.
