Is this classes as aggressive selling practice?

We were on the market with an agent from Oct-Dec. Decided not to continue as hadn't found a property. Found a property over Christmas and planned to go ahead with the house builders movemaker.

Previous agent calls to see what plans are as we originally said we would relist in spring. Told then about property and that we were going with movemaker- we even started the process.

Two days later we get a call from previous agent saying previous viewer now wishes to buy our house and is proceedable. We told house builders that the previous agent called and they had a buyer so what should happen in such instance? They have our reservation fee from movemaker so they just held off on getting new agents around as obviously better all around if we were proceedable off the open market.

Buyer is no longer proceedable (within 24 hours of viewing again!) was wasn't going to make an offer as they didn't want the north facing garden.

Would this be viewed as aggressive selling practice by the agent or is it just my naivety?

We wish to cancel contract (just out of 14 days), as so many issues as highlighted to me from another thread, and go ahead with movemaker which the housebuilder is willing to do.

Not sure if we have rights of will have to suck up paying the commission.
