I'm wondering if anyone has relocated within the UK without getting a Child Arrangement Order varied. I'm desperate for a larger property and have secured a mutual exchange from a 1 bed to a 2 bedroom so my LO can have their own room. The exchange will be authorised within the next couple of weeks. I have residency and let my child's father know. He is opposed to the move but he hasn't put in an application to prevent the move which is still in England - 2.5 hours drive. I put in a request for the order to be varied and the judge has said I need to put forward a contact proposal for the father and he needs to get legal advice and has listed my request for a further hearing. He indicated the hearing will be sometime in March. I'm worried that it will fall outside of the timelines the move needs to happen by and that we could lose out on the rare opportunity to finally upsize. No one wants to move to my area, its not the greatest place to live so I really can't mess around. I'm thinking of letting the court know the date of the move when I actually get and if the court can't give me a hearing by the date we need to complete the exchange by then just do the exchange and vary the order after and suffer whatever consequences might follow. Has anyone done this before? If so were there any repercussions for not getting permission to vary the order from the court?
