Accused of leaving scene of crash!!

I recently had a car crash with another driver who has refused to accept fault therefore insurance are now investigating. The problem is I’m now being called in for interview under caution for leaving the scene of the crash which I did not!

So I was driving home late from my parents with a passenger and on the way have been hit by another car which he is claiming was my fault. We both stopped and we were all fine luckily so we exchanged details. Whilst we were there he called two of his friends to the scene one of which was a very rude woman. We had exchanged details and I was in shock so myself and my friend walked back down to my parents but, i have now been called in for an interview because he has waited till we had left and then called he police saying I had not give him my details!! I now wish I had not agreed to not call the police cause I feel this was just a plot for him to make me look at fault for the crash! I’m so annoyed. As his two friends were there police are saying he has two witnesses but of course his friends are going to say whatever he wants them to say!!

I said it put me in mind of a similar situation and owing to the unpronounceable name don't believe it's that huge a leap.
Sounds like a well know cash for smash scam.

Bloody hell OP that's one hell of a smash.

Try not to worry. Tell them what happened and they can check it out with the witness. They can also talk to the insurance company to find out that he did have your details when he reported it. He's just an arse trying to get away with causing it.

Slow hand clap for Muppets reporting something that was put sensitively to help the OP avoid being scammed. It's a well known scam at that and why we all have to universally pay more insurance than ever. Address the source of the problem rather than people pointing out even the Police know about it, eh?

So what you thought you would just leave it there forever then? You were in a crash and then dumped your battered car in another road and left the scene without arranging for it to be taken away and notifying anyone. The police have every right to want to talk to you!

But you did leave the scene, regardless of whether you left contact details, not due to injury and in doing so were not available to speak to the police or, for example, give a breath test. Did you tell any of those who helped move your car that you would be down the road at your dm house if they needed to see you?

He had your telephone number. Why would you give him that but nothing else

Police want to speak to you because he has accused you of it. When he reported the crash before you, he had your details.

It does sound super dodgy though. Your phone was dead? Did your friend not have a phone you could use?
You didn't call the police and just walked off when his friends arrived, leaving your car?! Your car was so damaged because of a shoddy previous job?! It's all just a bit one thing after the after

OP, from your earlier posts, it seemed you'd driven off after exchanging details (which would have been reasonable).

What you're saying actually happened is that you abandoned your vehicle following an accident.

And the police woman said I just left my phone number and left the scene so therefore that’s not adequate even though I did pass him my name and address along with insurance details

^ This makes sense now - you abandoned your vehicle at the side of the road and went home; of course the police want to talk to you!

You left your car like that by the side of the road and wonder why the police want to speak to you?

You planned on leaving it there all night because you didn’t want to pay the £345 to tow it?

It’s called being an adult. That’s horrific!! Ignore the fact that his car was there for days. Hats not you. You walked off! At that time. With no regard or responsibilities to move your car! You hadn’t told the police that it would be left there in that state either.

You should have called the police after the accident, it wasn’t just a small bump. The fact you didn’t report it means you have no real evidence as to who was a t fault so you are unlikely to get any money from the insurance as he’s obviously not going to say it was his fault. I can’t believe you just left without calling the police when your car appears to be a total right off.

@herringbone31, do you not read? She went to arrange a tow. Not everyone has a spare few hundred quid laying about because a moron smashes into them negligently and then c calls their gang round to intimidate the OP.
Damn straight she walked away in that situation, and I hope Police will charge him for intimidation and lying to Police.

Right so I spoke to my solicitor and he said he doesn’t have any concerns as I haven’t done anything wrong by leaving after passing my details on and @Herringbone31 I couldn’t just pay for a tow truck there and then! I had to even borrow the money to pay to retrieve my car afterwards, what am I going to do if I don’t have the means to pay then! The crash has to be investigated which is what is happening and that is fine! The police woman has stated I’m being interviewed for leaving the scene without giving my details! That would be against the law which is not what I did at all. That is the issue! He is lying through his teeth! Im talking about how I’m being accused of leaving without giving details! That is what I’m being accused of!

I am really surprised the police are calling you for interview. Something similar happened to my dp and the police rang him. He explained that he had taken lots of photos of the scene, that the other driver refused to give his details or take details from dp. The police gave him the other drivers information and it was left to the insurers. That said, dp's was really really minor. Low speed, just a couple of dents and scratches. Yours looks like a full on smash that anyone is lucky to walk away from unscathed. If you were reported for leaving the scene and the police saw that vehicle just left, they would think you had fled as you were doing something illegal.
I really wouldn't worry, it's very easy to prove you didn't leave the scene and the police will very quickly close their file. For future reference, get a dash cam and get a phone charger for your car. I would be surprised if this is settled by the insurer in your favour of the other driver is denying liability. It will probably go 50/50.
